Terms & conditions

Last updated: September 2026

These Terms and Conditions apply to the use of the Party Walls Surveyors Ltd website and our online Instant Quote service.

Party Walls Surveyors Ltd is referred to in these Terms as “we”, “us” or “our”.

By using our website or submitting information through our Instant Quote or enquiry forms, you agree to these Terms and Conditions.

2. Instant Quotes

Our website provides an Instant Quote facility to help you obtain an indication of the likely fees for our services.

Any quotation generated through the website is based solely on the information you provide to us and on the assumptions stated within the quotation.

You are responsible for ensuring that the information you provide is accurate and complete.

An Instant Quote does not constitute legal advice and does not confirm whether particular works are or are not notifiable under the Party Wall etc. Act 1996.

We may need to review drawings, Land Registry information, ownership details or other documentation before confirming the services required and the final fee.

3. No Automatic Appointment

Obtaining or accepting an Instant Quote does not, by itself, appoint Party Walls Surveyors Ltd or any individual surveyor under the Party Wall etc. Act 1996.

Where a formal appointment is required, this will be dealt with separately by an appropriate written Letter of Appointment or other appointment document.

We are not instructed to commence professional party wall services merely because an Instant Quote has been generated.

4. Quotations and Fees

Unless otherwise stated, our quotations are based on the information available to us at the time.

If the scope of the proposed works, number of adjoining owners or ownership interests, property circumstances or services required differ from the information provided, we reserve the right to revise our quotation.

Any additional services or fees will normally be agreed or notified before the additional work is undertaken.

Where third-party fees may arise, including fees charged by another owner’s surveyor, structural engineer, checking engineer, Land Registry or other professional, these are not included in our fee unless expressly stated.

5. Party Wall Surveying Services

Our services may include, depending upon the instruction:

• reviewing proposed building works;

• preparing and serving Party Wall Notices;

• reviewing notices received;

• acting as Building Owner’s Surveyor, Adjoining Owner’s Surveyor or Agreed Surveyor;

• preparing Schedules of Condition;

• arranging inspections;

• liaising with owners, surveyors, architects and engineers;

• preparing and agreeing Party Wall Awards; and

• providing other services connected with the Party Wall etc. Act 1996.

The precise scope of our services will depend upon the instruction provided to us.

6. Information Provided by You

You agree to provide accurate and complete information where reasonably required, including details relating to:

• the property;

• the proposed building works;

• property ownership;

• adjoining properties and owners;

• architects, engineers and contractors; and

• relevant drawings and structural information.

We are entitled to rely upon information and documents supplied to us unless there is an obvious reason why we should not do so.

Delays in receiving information, drawings, access or responses from owners, occupiers, other surveyors or third parties may affect the timescale for completing our services.

7. Timescales

Any timescale given by us is an estimate unless expressly confirmed otherwise.

Party wall matters frequently depend upon statutory notice periods and responses from adjoining owners, occupiers, other surveyors and third parties. We cannot guarantee completion by a particular date where matters are outside our reasonable control.

8. Property Access and Inspections

Where an inspection or Schedule of Condition is required, suitable access must be provided by the relevant owner or occupier.

Appointments may occasionally need to be rearranged because of access difficulties, weather conditions, illness or other circumstances outside our reasonable control.

Where drone photography is proposed, this will also be subject to suitable weather, location and safe operating conditions.

9. Cancellation

Where you are acting as a consumer and instruct us remotely, including online, by telephone or by email, you may have statutory cancellation rights.

Where applicable, you normally have 14 days from entering into a service contract in which to cancel.

If you ask us to begin providing services during the cancellation period, you may be required to pay a reasonable amount for services properly provided up to the date on which you tell us that you wish to cancel.

Where the service has been fully performed during the cancellation period following your express request and acknowledgement, your statutory right to cancel may end once the service has been fully performed.

Nothing in these Terms affects your statutory consumer rights.

10. Website Information

We take reasonable care to ensure information on our website is accurate and current. However, information on the website is provided for general information and should not be treated as specific legal, structural or professional advice relating to a particular property.

Party wall matters depend upon the individual circumstances of the property, ownership and proposed works.

We reserve the right to correct errors and update information, services and prices displayed on the website.

11. Professional Liability

Our professional services will be provided with reasonable skill and care.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

We are not responsible for losses resulting from inaccurate or incomplete information supplied to us, matters outside the agreed scope of our instruction, or circumstances outside our reasonable control.

Any specific limitations applying to a professional instruction may also be set out in the relevant Letter of Appointment or Terms of Engagement.

12. Third Parties

During a party wall instruction it may be necessary to communicate with third parties such as adjoining owners, building owners, occupiers, surveyors, architects, engineers, contractors, managing agents, freeholders, local authorities and other relevant professionals.

Our website may also contain links to third-party websites. We are not responsible for the content or privacy practices of third-party websites.

13. Intellectual Property

14. Privacy

Personal information submitted through our website is handled in accordance with our Privacy Policy.

15. Changes to These Terms

We may update these Terms and Conditions from time to time. The current version will be published on our website together with the date it was last updated.

16. Governing Law

These Terms and Conditions are governed by the laws of England and Wales.

Any dispute arising from the use of our website or our services will be subject to the jurisdiction of the courts of England and Wales, subject to any statutory rights you may have as a consumer.
