Key Protections & Clarity

What's the Benefit of Having a Party Wall Award?

A Party Wall Award (also known as a Party Wall Agreement) legally protects both the building owner undertaking works and the adjoining owner, providing certainty, clear obligations, and dispute mitigation.

1. Legal Protection: A legally binding Award sets out the conditions for carrying out works under the Party Wall etc. Act 1996.
2. Clear Responsibilities: Defines the authorised works, access arrangements, working hours and each owner’s obligations.
3. Dispute Resolution: Provides arrangements for referring disagreements about the works to the appointed surveyor or surveyors.
4. Property Protection: Specifies appropriate safeguards to reduce the risk of damage and unnecessary disturbance.
5. Repairs and Compensation: Addresses making good damage or paying compensation where applicable.
6. Condition Record: Incorporates a Schedule of Condition as a reference point when assessing alleged damage.

Who Prepares the Award?

The Award is prepared by either:

– One Agreed Surveyor appointed by both owners; or
– Two surveyors, one appointed by each owner

Where two surveyors are appointed, they also select a Third Surveyor who may be called upon if they cannot agree.

The appointed surveyor or surveyors must act impartially when administering the Act.

Can Work Start Once the Award Is Served?

The building owner must wait until the Award has been formally served and the applicable notice period has expired before beginning the notifiable work.

Either owner may appeal the Award in the County Court within 14 days of service.

What Happens If Damage Occurs?

The building owner is generally responsible for making good damage caused by the notifiable works.

The Schedule of Condition provides a record of the adjoining property before work began. The appointed surveyor or surveyors can inspect the alleged damage and determine the appropriate remedy under the Act.
